Vendor Terms
1. Compliance with WhatsApp Policies
The Vendor agrees to strictly adhere to WhatsApp’s Business Policy and Commerce Policy. Any violation (such as sending prohibited content like gambling, adult content, or illegal drugs) that leads to account suspension will be the sole responsibility of the Vendor.
2. Anti-Spam Policy
* Vendors must ensure they have prior explicit consent (Opt-in) from every recipient before sending any marketing messages.
* Sending unsolicited messages (Spam) is strictly prohibited. If the "Report" rate exceeds the threshold set by WhatsApp, the Vendor's access may be terminated without a refund.
3. Content Responsibility
The Vendor is solely responsible for the accuracy, legality, and appropriateness of the content sent. Das Technology (or your platform) acts only as a technical intermediary and does not monitor or endorse the content of individual messages.
4. Opt-Out Mechanism
Vendors MUST include a clear way for users to unsubscribe (e.g., "Reply STOP to Opt-out"). Vendors are required to process these requests immediately and ensure no further messages are sent to such users.
5. Data Privacy & Ownership
* The Vendor owns the database of their customers.
* The Vendor agrees not to use the service to scrape data or harvest phone numbers illegally.
* The Vendor is responsible for maintaining the confidentiality of their account credentials.
6. Service Uptime and Delivery
* We aim for 99.9% API uptime; however, delivery depends on WhatsApp’s official servers and the recipient's network.
* We are not liable for non-delivery of messages due to incorrect numbers, blocked accounts, or WhatsApp server outages.
7. Suspension and Termination
We reserve the right to suspend a Vendor’s account immediately if:
* There is a high volume of "Block" or "Spam" reports.
* Payment is not made on time.
* The Vendor is found using the service for fraudulent activities.
8. Limitation of Liability
In no event shall the service provider be liable for any loss of profits, business interruption, or legal action taken by WhatsApp against the Vendor.
